ABA Journal: Are arbitrations out of control and missing the point?

And did Americans and Brits ensure that arbitrations would go bonkers? An ABA Journal piece this month (April 2010 issue) we nearly forgot to share. It's lengthy, but do read "International Arbitration Loses Its Grip: Are U.S. Lawyers to Blame?" The "Americanization" lament is a bit old, and maybe overstated in terms of blame--but here is a solid if disturbing report on the state of international arbitration in America and, to a large extent, abroad. "Cheaper, faster and better?" Hardly.
