Listen Up...
Listening arts. I've mentioned before that I still need work but am improving in this area. It's a constant focus. And my co-workers seem to like me more whenever I write about it. Two of my favorite bloggers, and each a lawyer I would hire in a heartbeat to serve my firm's clients if needed--Chicago's Patrick Lamb and New York City's Arnie Herz--have been writing a lot about listening lately, here and here. Just follow all the links. Patrick and Arnie have collected some great sources in these posts--and they know what they're talking about. You'll never hear me "instruct" on this subject. I just listen.

Dan,
David Boies is reported to be a great listner, but then: (1) his clients are smart enough to have something worth listening to; and (2)even if not, they will still pay his bill for the time he spends holding their hand.
Inquiring minds want to know, why do you fall short?
On the other hand, it is true that the 8th Circuit CJA rules permit only one face-to-face client meeting, reasoning that clients have nothing useful to add. Further questions can just be put in the mail.
Can you imagine writing a doper just off meth, "The court may impose a sentence of from 5 to life (because of the gun found in the waist band of your shorts and your prior felony). What sentence would you like? Best regards, Jon Doe, CJA panel member."

It's because I am a triple Type-A first child--and I am taught to talk and act--not listen....but I am getting there. Dan
